Terms and Conditions of Sale

1 - Object

DHERBEY MOTO provides its customers with the products on its website in accordance with these terms and conditions. These automatically apply between DHERBEY MOTO SARL and its customers for all present and future sales. The customer expressly agrees that these Terms of Sale waive the general conditions and specific purchasing conditions of the customer and that the said general conditions of sale can be modified only by an endorsement accepted by DHERBEY MOTO SARL. Only customers with DOM TOM as well as in foreign countries such as USA, Switzerland, Luxembourg, Canada, Finland, Greece, Portugal, Czech Republic, Singapore, Brazil, Belgium, Netherlands, Germany, Andorra, Argentina, Australia, Austria, Italy, Spain, Chile, Norway, Poland, Sweden, Denmark and England. For The DOM TOM oil, spray, paint bomb etc ... can not be sent by cause of refusal of the parcel at the airport. 2 - Products

3 - Orders and Regulations

The Buyer having taken cognizance of the products and their characteristics has, under his sole responsibility and according to his needs as determined beforehand before any order, made his choice on the product (s) being the subject of his Order DHERBEY MOTO makes available to the buyer to help him in his choice :

- a telephone number on 04 76 36 81 42 whereby he can have access to a technician from Tuesday to Friday from 8H to 12H and 14H to 19H ; Saturday from 8H to 12H

4 - Payment

Payment is made by secure payment with the Bank Card. The prices displayed on the website do not include delivery costs charged extra.

The price of the products is that in force on the website. Nevertheless, due to the scalability of the hardware or a certain unavailability, DHERBEY MOTO may have to change the availability and price of a hardware. In this case, DHERBEY MOTO will offer equivalent equipment. In all other cases, the price to be paid is that notified on the invoice or the acknowledgment of receipt of the order. A rebate granted to the customer can always be modified or canceled for any new order.

Cash payment is required. In case of banking incident, bank charges will be borne in full by the customer. At no time, the sums paid can not be considered as a deposit or installments.

The consumer guarantees that he has the necessary authorizations to use the method of payment when validating the purchase order.

The company reserves the right to suspend any order management and any delivery in case of refusal of authorization of payment by credit card from the officially accredited bodies. The company reserves the right to refuse to make a delivery or to honor an order from a consumer with whom a payment dispute is in the course of administration.

5 - Order concellation

The customer can not cancel his order. Any order can be canceled only by an express agreement of the 2 parties or by court decision or by DHERBEY MOTO following an invoice unpaid despite a notice to pay or in the case of a resumption of material in reserve Or by the customer in the case of a formal notice to DHERBEY MOTO, by registered letter with acknowledgment of receipt, to deliver unsuccessful more than 30 days.

6 - Reservation of title

In all cases, DHERBEY MOTO retains ownership of the materials sold until full payment of the sale price by the customer, for all present and future sales. DHERBEY MOTO is entitled, without previous formalities and independently of any legal action, to require the customer, at the expense of the latter and without objection, to return the equipment as soon as possible.

7 - Product unavailability

In case of unavailability of the ordered product, in particular by our suppliers or the quantity available in store that would have passed, the consumer will be informed by email or by telephone.

8 - Delivery

Delivery times given or accepted by DHERBEY MOTO are based on a predicted average delivery time and considered as indicative. No delay in delivery will justify a penalty for the benefit of the customer. Orders placed between Saturday 10:30 am and Tuesday 8:00 am will only leave on Tuesday, the store being closed on Sunday and Monday.

Upon leaving the company, the equipment is placed under the responsibility of the customer. In the event of damage, it belongs to the latter, failing to make all the necessary findings on the delivery note and to confirm his reservations within forty-eight hours by registered letter with acknowledgment of receipt to the carrier and DHERBEY MOTO. After this period, the customer is no longer entitled to contest the delivery.

9 – Shipping costs

The cost of transport is the responsibility of the customer. The conditions applicable are those expressed at the time of the order. The freight costs for Metropolitan France and Andorra are free for an order of products of an amount greater than or equal to € 225 excluding tax, within the limit of a package weight of 30 kg. For professionals with 2 wheels, the shipping costs for metropolitan France are free for an order of products of an amount greater than or equal to 400 € excluding taxes.

10 - Right to retract

The withdrawal period of the Buyer is 14 days.

The products must imperatively be returned to DHERBEY MOTO in a perfect state of resale, in their original state, and accompanied by the invoice or coordinates of the Buyer and full references of the order.

Similarly, if the product includes a guarantee sheet or any other document to be completed, it must not be completed in order for the Buyer to exercise his right of withdrawal.

Any product that is incomplete, damaged, or whose original packaging has been deteriorated so that the normal marketing of the product will be affected, will not be refunded.

Any risk related to the return of the product is the responsibility of the Purchaser.

The exercise of the right of withdrawal will give rise to a refund made by the means that was used by the Purchaser when paying the order.

11 – Guarantee

The only guarantee granted by DHERBEY MOTO is that granted by the manufacturer. Failures caused by normal wear, an external accident, abnormal use, ... are not guaranteed. The products in guarantee must be returned to the technical service of the company.

12 – Disclaimer - Insurance

By express agreement between the parties, DHERBEY MOTO is subject to an obligation of means, and in no case can DHERBEY MOTO be held liable for damages due to a cause beyond its control.

13 – Signature électronique et preuve

To order, the buyer must fill out the customer card. Validation of the order means acceptance of the order in full and at the price indicated. The validation of the order is equivalent to the signature and the express acceptance of the operations carried out on the site and constitutes an electronic signature which has between the parts the same value as a handwritten signature. The consumer acknowledges being fully informed that his agreement concerning the content of the present general conditions does not require the handwritten signature of this document, insofar as the customer wishes to order on-line the products presented in the shop of the site.

14- Protection of privacy

DHERBEY MOTO reserves the right to collect data on the user. The personal data are intended for internal use and may be communicated, unless objection notified by e-mail to commande(at)dherbeymoto.com, to organizations contractually linked in the execution of this order unless objection by you. The buyer has at all times the right of access and rectification of the personal data. He also has the right of opposition at any time by writing to DHERBEY MOTO.

15 – Dispute resolution and meditation

In the event of failure of the complaint request to Customer Service or in the absence of a response from this service, the Buyer may submit, free of charge, the dispute to the Médiateur du Conseil national des professions de l'automobile (CNPA), the mediator to which Dherbey Moto adheres, who will attempt, in complete independence and impartiality, to bring the parties together with a view to reaching an amicable solution.
